Why voting for Alan J. Lefebvre will enhance the judicial efficiency in Clark County Courts
I am seeking election to be a judge of the EIGHTH JUDICIAL DISTRICT COURT, (in department 14). That court is staffed by 32 departments of general jurisdiction judges, handling criminal and civil cases arising in Clark Court.
After more than 30 years as a civil law lawyer, I believe my extensive experience as a civil litigator will serve to bolster the depth of this court, in expediting civil lawsuits. More than one-third of the current roster of 32 judges lack any significant background in civil law, which is the area of law that will more likely touch Clark County residents. More than one-third had practice experience as public defenders or deputy district attorneys, before becoming judges. Lacking experience such as mine means they must learn civil law on the job and lack the confidence in civil law to cut to the chase and resolve cases without undue delay.
The term civil law refers to court cases that arise over a dispute between two non-governmental parties. It encompases person injury, contact disputes, employment cases, probate, disputes over construction failures and claims, corporate and LLC governance issues, property disputes in the HOA context and the like, licensing with governments, mechanics liens, banking disputes, election law, and matters pertaining to constitutional rights (2nd amendment and eminent domain) …..and the list goes on.
Lets face it, most law abiding citizens will not come in contact with the criminal justice system, God willing: we already have plenty of judges to make sure criminal cases proceed as justice requires. But when citizens face the labyrinth of a civil lawsuit, it is crucial that the judge hearing the case ,possesses the legal background to dive-in and decide the lawsuit with expertise and bring it quickly to a close.
That is what my background will enable me to do……….to expedite cases. Legal fees are ruinous to individuals and businesses, each day a case drags on. And “drag on” is what happens in most civil cases in Nevada state court. Truly, justice delayed is justice denied.
Who Is Alan J. Lefebvre?
Alan Lefebvre is the 89th president of the State Bar of Nevada, 2013- 2014.
He conducts a statewide civil trial practice in Nevada urban and rural counties, prosecutes and defends appeals in its state Supreme Court and Court of Appeals, is a zealous advocate in its federal courts and in arbitral forums, and postures cases to win, in mediation. At the state appeals level, he engages in “bet the company” civil writ practice, when trial judges err before trial.
